The U.S. Constitution (Contract Clause, Article 1, Section 10, Clause 1) and the Arizona Constitution (Article 2 Section 25. (No bill of attainder, ex-post-facto law, or law impairing the obligation of a contract, shall ever be enacted.)) Both state that government is prohibited to enact laws that interfere with contracts.

HB 2084 requires condominium and planned community associations to file contact

information with the Arizona Corporation Commission (ACC), instead of the county

recorder. HB 2084 was amended in the Government and Higher Education Committee

to add the association’s website to the statement filed with the ACC, and to specify

where written responses to violation notices be sent.


HB2255 nothstanding subsection A of this section, in the case of injury to real property or an improvement to real property, if the injury occurred during the eighth sixth year after the substantial completion, or, in the case of a latent construction defect, was not discovered until the eighth sixth year after substantial completion, an action to recover damages for injury to the real property may be brought within one year after the date on which the injury to real property or an improvement to real property occurred or a latent construction defect was discovered, but in no event may an action be brought more than nine seven years after the substantial completion of the improvement


SB1048 amending sections 12-302 and 12-3201, Arizona Revised Statutes; relating to vexatious litigants.


SB1091 - Modifies requirements regarding the removal of a member of the board of directors (Board) for a planned community.


SB 1385  - Provides requirements with regard to certain specified roads and parking areas in a planned community.


SB1452 - Provides requirements for condominium and planned community homeowners’ association (HOA) elections to replace a removed member of the board of directors.


SB1453 - Modifies requirements regarding unit owners’ associations (UOA) and homeowners’ associations (HOA) late assessment and violation notifications.
